Thank you for visiting our website. The protection and the security of our users’ personal data is a fundamental concern for GenoTher. This personal data protection policy explains which data will be collected when you visit our website and how it is processed.

GenoTher is the data controller for the personal data that may be collected via this website and processed for the purposes described below.

About us

GenoTher is an association whose mission is to promote the development of the French gene therapy sector and to create a global competitiveness cluster, covering all aspects of research to industrialization, production, provision of treatments to patients, creation of economic value, creation and development of companies, the development of training in order to create a global competitiveness cluster to meet the needs of the sector.

The mission and actions of the GenoTher association are in compliance with national and international laws and ethical recommendations. To ensure compliance with these rules, GenoTher has appointed a contact person in the organization on issues relating to the protection of personal data.

How you are impacted by this policy

  • You are a regular visitor to the GenoTher website;
  • You want to contact us via the form available on the Genother website;
  • You are a candidate for one of our job offers;
  • You are a co-contractor of future co-contractor of GenoTher.

If your situation does not match one of the above profiles, the procedures and purposes of processing your personal data is collected. You can also contact your usual referents or ask your questions to the GenoTher referent (dataprivacy@genother.org).

Why we collect your data

Depending on the type of inquiry, we may collect your data for various reasons (purposes):

  • On the basis of legitimate interest, to better respond to your inquiries : depending on your questions (requests for information, partnerships, employment etc….), your requests may be re-routed to all GenoTher members (see the list below) ;
  • On the basis of legitimate interest, for the purposes of administering the Genethon website : cookies ;
  • In accordance with our legal obligations, for job applications : in order to respond to your application, we collected a certain amount of personal data via the GenoTher Linkedin account in order to process your applications for the selected position in the best possible way (when we receive your CV and cover letter) ;
  • On the basis of legitimate interest, out of the need for good cooperation when sitting up and fulfilling a contract.

The personal data that we collect

Généthon collects the following data:

  • (a) Data collected when you visit our website : these are cookies. For more information, please refer to paragraph K. of this document ;
  • (b) Data collected when you fill in the contact form (s) on our website : your name and email address (mandatory information to be completed) are collected in order to transfer you to the relevant internal department to obtain the most relevant response. In addition, it’s possible that you made provide us with additional personal data, via the fields of our contact forms, depending on your request. Please note that we invite you to only provide us with data that may be useful for the processing of your request;
  • (c) Data collected when you apply for one of our job offers: the information contained in your CV (e.g. surnames, first names, postal address, e-mail address, telephone number, photograph, education, employers, interests, etc.) as well as this same information, via the GenoTher Linkedin account, is collected in order to evaluate your application;
  • (d) Data collected when you are in contact with our services in the context of the establishment and implementation of a contract: surname, first name, professional e-mail address, professional telephone number.

Who has access to your data

We collect two types of data:

1. Contact form data

Your data collected via the contact forms may be transmitted to all members of the GenoTher association. Depending on the request, the data from the contact forms will be forwarded to the member concerned. The members of GenoTher who may receive your data are the following:

In some cases, we may be required to disclose your personal data in response to a court order, subpoena, law or regulation. We consider cooperating with such requests, taking the necessary steps to ensure that the requester understands the confidential nature of the personal data entrusted to them. We also reserve the right to cooperate with public authorities in investigating and prosecuting website visitors who violate our rules or engage in harmful or unlawful conduct towards other visitors or the personal data for which we are responsible.

2. Data in the context of other services

Finally, in the context of the use of our services, we may use service providers who are contractually bound by the same confidentiality and security obligations as GenoTher. The service providers put in place measures to ensure optimal data protection. You can access the full list of service providers who have access to your data by making an access request at the address dataprivacy@genother.org .

How long your data is stored

Generally, GenoTher only keeps your Personal Data for as long as is necessary to achieve the purposes for which it was collected. 

Your data is therefore kept:

  • Up to 1 year for data required to manage the site: this includes visitor identities and connection data;
  • Up to 13 months for cookies;
  • Up to 1 year for data supplied by you via the GenoTher site contact form;
  • Up to 2 months for application data. On Linkedin, candidate CVs are kept for the duration of the recruitment process. Once recruitment has been finalized, CVs are deleted, except for the candidate’s personal file.
  • For the duration of the contract, for data exchanged during the establishment and implementation of a contract.

Your data may then be archived for a period that complies with current legislation.

How to exercise your rights

In accordance with the French Data Protection Act of January 6, 1978, you have a right of access, rectification, opposition, limitation and since the General Data Protection Regulation (RGPD) came into force on May 25, 2018, a right to erasure of your Personal Data and a right to portability.

  • (1) You may request to obtain a copy of your Personal Data as well as information on how the Personal Data is processed and its legal basis ;
  • (2) You may ask for your Personal Data to be corrected if it is inaccurate (including the right to complete incomplete Personal Data);
  • (3) You may ask for your Personal Data to be deleted (in certain cases, this right may only apply when the data is no longer necessary to achieve the purposes for which it was collected or processed);
  • (4) You may request to restrict the processing of your Personal Data where: (a) the accuracy of the Personal Data is disputed, (b) the processing is unlawful, (c) GenoTher no longer needs your Personal Data but it is still necessary for the establishment, exercise or defense of legal claims;
  • (5) You may object to the processing of your Personal Data;
  • (6) You may withdraw your consent to the processing of your Personal Data.
  • (7) You may request to obtain or consult a copy of the appropriate measures taken to transfer your Personal Data to a third country or to an international organization.

Transfers outside the European Union (UE)

In the event that your Data is transferred outside the European Union, GenoTher will take appropriate steps to ensure that your Personal Data is afforded the same level of protection as if it had remained within the EU, including by entering into data transfer agreements, based on Standard Contractual Clauses approved by the European Commission as updated or revised.

You have the right to obtain information concerning the transfer mechanism by which your Personal Data is transferred outside the EU and the country to which this transfer is made by contacting dataprivacy@genother.org.

Security measures

We implement all technical, organizational, and structural measures to ensure a high, adequate and appropriate level of protection for the use of your data. However, we would like to point out that no data storage system is infallible.
